GeneaNet

GeneaNet.org ("the web site") is a web site operated by GeneaNet SA ("GeneaNet"), GeneaNet 8, rue Armand Moisant 75015 Paris France.

GeneaNet is hosted by Claranet, 68 rue du Faubourg Saint-Honoré, 75008, Paris, France. Jacques Le Marois is Chief Executive Officer of GeneaNet SA and publishing director of the web site.

GeneaNet provides online services related to genealogy and family history, and members can build and share their Online Family Tree, search the GeneaNet database, upload and share archival records and family pictures, etc.

Our partner web sites may link to the data provided by the GeneaNet database.

By accessing and using GeneaNet, you accept and agree to be bound by the GeneaNet Terms of Service.

The GeneaNet Terms of Service are available from the account creation form and from the footer of the web site.

These Terms of Service will apply to every new service provided by GeneaNet.

Visitor: A non-registered user of the web site.

Member: A GeneaNet user who has registered for free to access or use certain services, features and content on the web site.

Club Privilege Member: A GeneaNet Member who has subscribed to the Club Privilege to access or use additional services, features and content on the web site.

You: The Member and the Club Privilege Member.

Account: The profile, preferences, genealogy data and archival records of the Member and the Club Privilege Member.

Member Content: The messages, questions and suggestions posted by the Member or the Club Privilege Member in the Forums and the Discussion Topics.

Archival Records: See Section 6.

The Services provided by GeneaNet are: the genealogy database, the Online Family Tree, the Club Privilege, the Archival Records, the Forums & Discussion Topics, the Online Shop, etc.

4.1/ Pääsy sivulle

Anyone can access the web site for free. Some services are reserved for registered members (see Section 4.2-d) and some other services are reserved for Club Privilege members (see Section 5).


4.2/ Rekisteröityminen palveluun

a/ Rules

Visitor can sign up using the membership subscription form. New Member will receive a registration confirmation email.

Subscription is open to any individual and non-profit organization. Commercial organizations are not entitled to register to GeneaNet.

Visitor who choose to create an Account agree to provide only true, current, accurate, and complete registration information (full name, date of birth, postal address, email address), and to update that information promptly after it changes. Your IP address will be stored by GeneaNet.

GeneaNet has the right to suspend or terminate any Account that contains incomplete or false information.

Member accept and agree to be bound by the GeneaNet Terms of Service.

GeneaNet email messages may not be rejected by email address validation and anti spam systems.

Member accept to receive admin messages that give information about GeneaNet change of use.

Member has the right to access personal information held by GeneaNet and to ask for its rectification (see Section 6).


b/ Username and Password

During the registration, Member will be required to select a username and a password. Username is unique and allows GeneaNet to identify Members.

Username may not be considered obscene or offensive.

Member shall not share the login Information (username & password). Member is solely responsible for maintaining the confidentiality of the login Information, and will be responsible for all uses of the login Information.

Member must sign in to access or use services, features and content on the web site.

If you have forgotten your password, use the 'Forgot Password' option from the login page and current login information will be emailed to you.


c/ Termination

Account may be terminated by either party without notice at any time for any reason and without penalty.

GeneaNet reserves the right to suspend or terminate any Account that violate Terms of Service.

d/ Account

You can create as many GeneaNet Account as you want.

Account includes profile, preferences, genealogy data and archival records.

Every Member has a free GeneaNet FTP personal folder. This folder must be used to temporary upload genealogical files that will be imported by GeneaNet. You shall not use the FTP folder for any other contents.

Data and files uploaded by the Member are for non-commercial use. GeneaNet reserves the right to terminate any Account that violate this rule and GeneaNet may file a lawsuit against the Member.

GeneaNet-käyttäjät saavat Kultaklubi-jäsenyyden tilaamalla ja maksamalla 40 euron vuotuisen jäsenmaksun. Sen jälkeen he voivat käyttää mm. seuraavia palveluita:

• Tarkennettu haku -ominaisuudet,
• Mainokseton sivusto,
• Pääsy Kokoelmiin (vanhat kirjat, transkriptiot jne.)
• jne.
• Kun Kultaklubi-jäsenellä on useampi kuin yksi GeneaNet-tili, vain yksi näistä tileistä voidaan liittää Kultaklubi-tilaukseen.
  
  Kultaklubiin liittyvät käyttäjät vakuuttavat täyttävänsä palvelun käytölle asetetut ehdot ja maksaneensa vuotuisen jäsenmaksun.
  
  Vuosijäsenyys sitoo Kultaklubin jäsentä yhden vuoden ajan jäsenhakemuksen hyväksymispäivästä lähtien.
  
  Jäsenmaksua ei palauteta, vaikka jäsen ei käyttäisi Kultaklubin palveluja.
  
  Toisaalta mikäli GeneaNetistä johtuvista syistä Kultaklubi-jäsen ei pääse käyttämään palvelua, jäsen voi pyytää jäsentilauksensa perumista ja jäljellä olevan käyttämättömän ajan hinnan takaisinmaksua tai prograatiota yhtä pitkältä ajalta kuin palvelu ei ole saatavilla.
  
  GeneaNet muistuttaa sähköpostilla käyttäjää tilauksen uusimisesta tilausajan loppupuolella.
  
  Kultaklubi-tilausta ei koskaan uusita automaattisesti eikä GeneaNet koskaan laskuta jäsenyydestä ilman käyttäjän vahvistusta.
  
  Tilaus perutaan ellei sitä uusita.
  
  Maksun voi suorittaa verkossa Visa-luottokortilla, MasterCardilla tai pankkisiirrolla.
  
  Kultaklubi-jäsenyyden hinta tarkastetaan vuosittain, ja sen suuruus riippuu palvelun sisältämistä uusista palveluista.
  
  Jäsenyys on rajoitettu vain luonnollisille henkilöille. GeneaNet Kultaklubin jäsenyys on henkilökohtainen. Jäsenet sitoutuvat olemaan paljastamatta kirjautumistietojaan kolmansille osapuolille, lukuun ottamatta samassa taloudessa asuvia perheenjäseniä. Tämän säännön rikkominen johtaa tilauksen peruuttamiseen eikä käyttämättä jäänyttä jäsenyysaikaa hyvitetä.

  'Archival Records' is a service by GeneaNet.
  
  This service allows Members to upload and index personal digitized records, and to attach them to their Online Family Tree.
  
  An Archival Record may be baptism/birth/marriage/death/burial certificate, Census sheet, etc.
  
  Archival Records may respect the Terms of Use of the repository or the web site where you got it from. GeneaNet may delete Archival Records that don't respect copyright law, intellectual property, privacy and other rights.
  
  GeneaNet will not sell Archival Records.

• 7 - Henkilörekisterit

  'Archival Registers' is a service by GeneaNet.
  
  This service allows Members to upload and index batch of personal digitized records.
  
  An Archival Register may be a Parish Register, a parish/city/town Census, etc.
  
  Archival Registers may respect the Terms of Use of the repository or the web site where you got it from. GeneaNet may delete Archival Registers that don't respect copyright law, intellectual property, privacy and other rights.
  
  GeneaNet will not sell Archival Registers.

• 8 - Kirkonkirjojen transkriptiot

  'Indexes' is a service by GeneaNet.
  
  This service allows Members to upload and share their genealogical indexes. These Members are then called Submitters.
  
  GeneaNet may delete Indexes that don't respect copyright law, intellectual property, privacy and other rights.
  
  Indexes are your property and are published for free on the GeneaNet web sites.
  
  Our partner web sites may link to Indexes provided by the GeneaNet Members.
  
  GeneaNet will not sell Indexes.

  During the registration, Member will be required to provide personal information. Member accept and agree that this personal information will be stored by GeneaNet.
  
  The above-mentioned personal information may be provided to partners. Third parties are responsible for marketing and sales content. GeneaNet guarantees that marketing and sales content will not be offensive or inappropriate.
  
  You can unsubscribe from our partners newsletter in your GeneaNet Account and you can request that we stop using your personal information by sending us an email.
  
  GeneaNet reserves the right to use your personal information by request of the law.
  
  According to article 78-17 of the French 'Loi Informatique et Libertés' of January 6, 1978, you can be informed of your rights, for example, for rectification and deletion of data on demand. Geneanet.org is registered by the Commission Nationale de l'Informatique et des Libertés (independent French administrative authority whose mission is to ensure that data privacy law is applied to the collection, storage, and use of personal data) under no 695885, May 26, 2000.
  
  You can update and delete personal information at any time in your GeneaNet Account and you can ask GeneaNet for the deletion of personal information.
  
  When you unsubscribe from GeneaNet, your personal information will be held by GeneaNet for a period of prescription defined by article 2262 of the French Civil Code.
  
  You can update and delete your genealogical data at any time.
  
  You can ask a GeneaNet Member for the deletion of personal information in their Account. Data privacy law allows anyone to ask for the deletion of their personal data and the one of their minor children.
  
  You may delete personal information in your GeneaNet Account when asked by anyone.
  
  GeneaNet reserves the right to suspend and delete the Account of the GeneaNet Member who doesn't respect the above-mentioned rule.

  Member recognizes that he or she has requirements to:
  
  - Update and delete personal information in its GeneaNet Account
  - Update subscription to the GeneaNet Newsletters

  Member agree to update personal information (postal address, email address) promptly after it changes.

• 11 - Keksit (Cookies)

  Cookies are stored on the Member's hard drive in order to provide targeted services and to process statistics.
  
  You can disable cookies on your computer but you will not have access to some of the services on the web site without the use of the cookie.

  You shall not use the web site in any manner that violates any applicable law and these Terms of Service.
  
  You shall use the web site only for non-commercial purposes.
  
  You shall not resale or use any contents on the web site for commercial use.
  
  You shall not redirect Visitors and Members to illegal web sites and to web sites that do not respect these Terms of Service.
  
  You shall not use your Account to advertise, or solicit, or transmit any commercial advertisements to anyone.
  
  The personal mailbox is provided by GeneaNet to allow Members to discuss and share about genealogy research in a non commercial manner. Messages sent by Members via their personal maibox is considered as private information. GeneaNet is not responsible for the contents of these messages. Member shall not use the personal mailbox to send spams and commercial messages. GeneaNet reserves the right to suspend and delete the Account of the GeneaNet Member who doesn't respect the above-mentioned rule.

• 13 - Käyttäjän vastuu

  Member is solely responsible for the contents that he or she uploads on the web site (profile, genealogical data, archival records, forum messages, etc.)
  
  Member may respect privacy law and intellectual property.
  
  In case of lawsuits filed against GeneaNet due to illegal Member contents, expenses will be charged to the Member.
  
  The above-mentioned rule applies to the GeneaNet partners.
  
  GeneaNet reserves the right to delete illegal contents without notice.
  
  When the Member provides links to external web sites, he or she is solely responsible for the contents of these pages.
  
  GeneaNet is not responsible for the genealogical data provided by its Members who may cite their sources.
  
  Member may not attack GeneaNet.

  Member is solely responsible for protection of his own system against viruses, malware, etc. GeneaNet is not responsible for any damage caused by such computer code.
  
  Member is solely responsible for securing its data.
  
  
      14.3/ Pääsy sivulle / Sivun päivitys
  
  GeneaNet reserves the right, in GeneaNet's sole discretion, to change the web site and its content for any lawful purpose, including changes to enhance the web site or correct any inaccuracies contained on the web site.

  In case of lawsuits filed against GeneaNet due to illegal Member contents, expenses will be charged to the Member.

  If GeneaNet makes any material changes to these Terms of Service, GeneaNet will announce those changes on the web site. Your continued use of the web site after such an announcement will constitute your acceptance of the amended Terms of Service.

• 17 - Force majeure

  GeneaNet shall not be liable for any delay in performing any of its obligations under these Terms of Service if such delay is caused by circumstances beyond its reasonable control and as such GeneaNet shall be entitled to a reasonable extension of time for the performance of such obligations. Should this period of force majeure last more than 30 days, both parties are entitled to cancel the agreement unilaterally via a certified letter with return receipt.

  The web site is a service provided, controlled and operated by GeneaNet from offices, facilities and computer systems located in France.
  
  If any provision of these Terms of Service is unenforceable or inapplicable to a dispute between you and GeneaNet, you and GeneaNet agree that such dispute shall be resolved and finally settled by mutually binding arbitration conducted in accordance with the French Law. The arbitration shall be conducted in the French language. To the extent permitted by said rules, the location of the arbitration shall be in Paris, France.
